What does IDEA say about Assistive Technology?

IDEA is the safeguard for every student with a disability to receive a free appropriate public education (FAPE). IDEA requires that school districts provide special education, related services and supplementary aids and services based on the student's Individualized Education Program (IEP) to assure FAPE.

"Each public agency must ensure that assistive technology devices or assistive technology services, or both, …are made available to a child with a disability if required as part of the child's (1) Special education…(2) Related services…or (3) Supplementary aids and services…." Additionally, IDEA states that "on a case-by-case basis, the use of school purchased assistive technology devices in a child's home or in other settings is required if the child's IEP team determines that the child needs access to those devices in order to receive FAPE." (IDEA 300.15)

Within the development, review and revision of the IEP, "the IEP team must…consider whether the child needs assistive technology devices and services." (IDEA 300.324) This consideration must be conducted for EVERY student with a disability and be documented within the special factors page of the IEP.

The key question related to the educational relevance of assistive technology: Is the provision of an assistive technology device or service necessary for the student to receive FAPE?
